1. Acceptance of Terms
By downloading, installing, accessing, or using Monisy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Monisy is a personal finance management application that helps users track income, expenses, budgets, savings goals, and other financial activities. The App is a tracking and organizational tool only.
2.1 Not Financial Advice
Monisy is NOT a financial advisor, bank, investment platform, or licensed financial institution. The App does not provide financial, investment, tax, legal, or accounting advice. Any financial insights, predictions, spending analysis, or suggestions generated by the App are for informational and organizational purposes only and should not be considered professional financial advice. Always consult a qualified financial professional for financial decisions.
2.2 Not a Banking Service
Monisy does not connect to bank accounts, process payments, transfer funds, or perform any banking operations. All financial data in the App is entered manually by the user. The App is a personal record-keeping tool.
2.3 Accuracy of Data
The accuracy of the financial data in Monisy depends entirely on the information you enter. We are not responsible for any errors, inaccuracies, or omissions in the data you input.
3. User Eligibility
You must be at least 13 years of age (or 16 in the European Economic Area) to use Monisy. By using the App, you represent that you meet this age requirement.
4. User Accounts and Security
4.1 No Account Required
Monisy currently operates without user accounts or online authentication. All data is stored locally on your device.
4.2 Device Security
You are responsible for maintaining the security of your device and access to the App. We recommend enabling the PIN and/or biometric lock feature to protect your financial data.
4.3 Data Responsibility
You are solely responsible for maintaining backups of your data. Since data is stored locally, device loss, damage, theft, or app uninstallation will result in data loss unless you have created a backup using the App's backup feature.
5. Premium Subscription
5.1 Free and Premium Tiers
Monisy offers both a free tier with core features and a Premium tier with additional features. The specific features included in each tier are described within the App and may change over time.
5.2 Pricing
Premium is available as:
- Monthly subscription: $4.99 USD per month
- Annual subscription: $29.99 USD per year
- Lifetime purchase: $69.99 USD one-time payment
Prices may vary by region due to local currency conversion and app store pricing policies. We reserve the right to change prices with reasonable notice. Price changes will not affect existing active subscriptions until their renewal date.
5.3 Free Trial
New Premium subscribers may be eligible for a 7-day free trial. During the trial, you have access to all Premium features. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription.
5.4 Payment and Billing
All payments are processed through Google Play Store (Android) or Apple App Store (iOS). By purchasing a subscription, you agree to the respective store's terms of service and payment policies. We do not directly handle payment information.
5.5 Automatic Renewal
Monthly and annual subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your Google Play or Apple App Store account settings.
5.6 Refunds
Refund requests are handled by the Google Play Store or Apple App Store in accordance with their respective refund policies. We do not process refunds directly. If you believe you are entitled to a refund, please contact the respective store's support.
5.7 Lifetime Purchase
The lifetime purchase grants Premium access for the lifetime of the App on the platform where it was purchased. This does not transfer across platforms (e.g., a lifetime purchase on Android does not automatically apply to iOS).
6. Acceptable Use
You agree to use Monisy only for lawful, personal finance tracking purposes. You agree NOT to:
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
- Modify, adapt, or create derivative works based on the App
- Use the App for any illegal, fraudulent, or unauthorized purpose
- Attempt to circumvent any security features, including premium access controls
- Redistribute, sublicense, or resell access to the App
- Use automated systems or bots to interact with the App
- Introduce malicious code, viruses, or harmful content
7. Intellectual Property
7.1 Ownership
Monisy, including its design, code, visual themes (Aurora/Glassmorphism design system), graphics, icons, user interface, and all related intellectual property, is owned by Monisy and protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
7.3 Your Content
You retain ownership of the financial data you enter into the App. We do not claim any ownership rights over your data.
8. Disclaimers
8.1 "As Is" Basis
Monisy is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2 No Guarantee of Accuracy
We do not guarantee the accuracy, completeness, or reliability of any calculations, insights, predictions, or analysis generated by the App, including but not limited to financial insights, spending predictions, anomaly detection, and auto-categorization. These features use statistical algorithms and pattern matching that may produce inaccurate results.
8.3 Data Loss
We are not responsible for any loss of data due to device failure, theft, damage, software errors, operating system updates, or user actions (including accidental deletion or failure to create backups).
9. Limitation of Liability
To the maximum extent permitted by applicable law, Monisy and its developers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or financial losses arising from:
- Your use of or inability to use the App
- Any errors, inaccuracies, or omissions in the App's features or calculations
- Unauthorized access to your device or data
- Financial decisions made based on information provided by the App
- Interruption or cessation of the App's functionality
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for Premium subscription in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Monisy, its developers, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of any third party.
11. Termination
11.1 By You
You may stop using Monisy at any time by uninstalling the App. If you have an active Premium subscription, you must cancel it through your app store account settings to avoid further charges.
11.2 By Us
We reserve the right to terminate or suspend access to the App at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms.
11.3 Effect of Termination
Upon termination, your license to use the App is immediately revoked. Data stored locally on your device will remain until you uninstall the App or clear the data.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting updated Terms within the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the App.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer is based, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Monisy regarding your use of the App and supersede any prior agreements.
